Advance Directives for Health Care, Living Wills,
and Powers of Attorney | Competency and Decision-Making Capacity
The Patient Self-Determination Act of 1991 (PSDA) requires
hospitals, nursing homes, and organizations receiving Medicare and
Medicaid funds from the federal government to notify patients of
their right to express their wishes concerning life-sustaining care
and of the laws of the relevant state with respect to advance directives.
The law does not require patients to sign such a document.
