Update on Liability Insurance Program

The purpose of this article is to keep APA members abreast of recent developments involving the APA-endorsed Psychiatrists’ Professional Liability Insurance Program.
At the end of November the Pennsylvania Commonwealth Court wrapped up its hearings on whether to place Legion Insurance Company in liquidation and gave the parties the opportunity to submit additional written filings. Based on the schedule set by the court for these additional filings, it was anticipated that no decision would be made by press time (end of December).
As part of APA’s efforts to advocate for its member insureds, APA filed a statement of interest with the court detailing the adverse consequences to psychiatrists and their patients if Legion is placed in liquidation. Psychiatrists’ Purchasing Group (PPG), which serves as sponsor of the Program, also submitted a filing and made an oral presentation to the court.
With respect to claims from the past, there are still many unanswered questions as to what would happen if Legion were placed in liquidation. We continue to work with the appropriate parties to find answers. APA has also continued to press very hard to encourage Professional Risk Management Services Inc. (PRMS) and our insurance consultants to find insurance products for those who may not have sufficient coverage for “prior acts.”
